US Secretary Pompeo Asked to Stop the Chinese to Help Sri Lanka Militarily in the North-East of Sri Lanka

We the Tamils would prefer the US military to provide protection for the Tamils, especially in the North-East of Sri Lanka.

NEW YORK, NEW YORK, USA, May 18, 2019 / —
The following letter written to the US Secretary of State to Stop the Chinese to Help Sri Lanka Militarily in the North-East:

The Honorable Mike Pompeo
Secretary of State
U.S. Department of State
2201 C Street NW
Washington, DC 20520

Re: US Secretary Asked to Stop the Chinese to Help Sri Lanka Militarily in the North-East.

Dear Secretary Pompeo,

We the Tamils for Trump are writing this letter to plead for a stop the Chinese involvement in North-East of Sri Lanka, which is the Tamils’ inheritance and their homeland over thousands of years.

On the last occasion when the Tamils fought for their freedom from Sri Lanka, Chinese-made weapons were used to destroy the Tamils’ homeland and killed more than 145,000 Tamils.

The Chinese are ruthless and have no respect to human rights. We do not want them to come to North-East in the name of suppressing the Tamil struggle for freedom, wrongly viewed by the oppressive Sinhalese establishment in Sri Lanka as separatist terrorism. It is instead a fight for justice and independence, principles on which the United States was also founded.

We the Tamils would prefer the US military to provide protection for the Tamils, especially in the North-East of Sri Lanka.

Regarding the Islamic terrorism so recently in the news, the US army must come to Sri Lanka and eradicate this threat.

To remove the genocidal Sri Lankan military from the North-East and to allow Tamils to live in peace, it is necessary to bring the UN peace keeping force to this part of Sri Lanka.

In the final analysis, the US needs to help arrange a referendum to decide the Tamils' future. The Sri Lankan government cannot be trusted.

Thank you very much for your time and consideration.

Don Juravin reviews

Don Juravin reviews

US: Only 20% in Congress & 25% state legislators Vs. Israel with 51% female judges and a female Prime Minister in the 70's. Europe with 38% governing females.

America, as leader of democracy, has no fair share representation of governing women. I'm against handing out any special "equal right" to women as they are strong on their own and need no charity.”

— Don Karl Juravin

Don Karl Juravin (An American born in Israel to a European family) researched and discovered that women are badly misrepresented in office in the country that boasts of the most diversity and gender equality. The military and the political arena are a reflection of women leading and governing.

US: Only 20% in Congress & 25% state legislators Vs. Israel with 51% female judges and a female Prime Minister in the 70's. Europe with 38% governing females.

How many women are involved in governing the United States?

Juravin answers that the number is not enough. Only 20% of Congress is female.

1. Only 110 women have seats in Congress, as of 2018. This makes the total of female representatives 20%.
2. Only 74 women hold executive elected positions in the United States.
3. Only 1,875 state legislators are women, out of a total of 7,383 seats. This makes the total of female state legislators 25%.
127,400,000 women are eligible voters in the United States.

Women want to run for president. In the year 2019, at least two have announced that they will be running. But will their willingness to run and their ability to fundraise help them?

America markets itself as the land of opportunity, the country of advancements, and leading the democratic world. As Juravin discovered, the numbers tell a different story.

The United States just had its first female candidate running for office in 2016. While she was not seen by the American people as worthy of the presidency, it took the United States almost a hundred years to have a female candidate campaign for the seat.

In the past century, there have been over one hundred elected female state leaders in the world. But none of these leaders have come from the United States. In Juravin’s opinion, this seems to be the only country where the people still have strenuous objections to a woman being in charge.

In 2018, according to Rutgers, 110 women hold seats in Congress, out of the 535 seats available. Only 20% of Congress is female, as of 2019. But 50% of the population in the United States is female. How can people expect proper legislation on female issues, such as reproductive rights, to be passed with the women in mind? There has only been one female speaker of the House, which according to Juravin is far too few to fully represent women.

In terms of the state legislature, Juravin determined 74 women hold executive elected positions across the country, which makes 23.7% of the positions in state office held by women. Out of the 50 states, there are six female governors and 13 lieutenant governors. 1,875 of state legislators are women. There are 7,383 seats in the state legislature, making the percentage of female participants around 25%.

52% of the eligible voters in the country are women, out of a possible 245 million voters. Yet the amount of women participating in government does not reach higher than 25%.

Women vote in higher numbers and tend to vote more frequently than men. Since 1964, women have outnumbered men in votes. More women typically register to vote, and more women tend to vote a certain way. Men typically vote less frequently and vote for those that have their interests. In Juravin’s opinion, women tend to vote in the opposite direction.

Even worse, this percentage is historically the highest percentage of women in Congress. There is so much more work to do.

In the book, Women in Politics: An International Perspective, Vicki Randall explains that the reason why men have a difficult time seeing women in leadership positions. The home has no politics, while the public square is all politics. But I argue that men need to see things differently. The home is political: the mother has to handle the children and command their respect.

The home is also affected by public politics. There is no way to separate the different platforms of life so that they do not affect each other. In the same way, politics is affected by family life. There is no wall between these two conventions.

Women have to realize that this is not a fight to the death. This is the same as dealing with an unruly, unwilling child. One must compromise. Women in politics have to work with men. We cannot have an all-female Congress or a matriarchy, just as we cannot have an all-male Congress or patriarchy. The split must be even.

In Israel, women are a more prominent part of politics. The statistics don’t lie. 51% of judges in Israel are female. There have been 17 female Israeli cabinet ministers. Dozens of women have served as members of Parliament. Israel’s first female prime minister was elected in 1969. America has yet to elect a female president.

One woman at the International Women’s Day Conference in Israel testified that she came to Israel from the Soviet Union with ten dollars in her pocket. She became a member of Parliament and a mayor of a city.

Europe falls in between Israel and the United States. Germany has a female prime minister now. However, France and Italy have yet to elect a female prime minister.

In Germany, seven of the 16 cabinet positions are filled by women. 30% of the members of the German parliament are women. At most, Germany had 36% of Parliament as female.

In France, while there are no female leaders, women are almost half and a half with the men in political life. 41% of state and local politicians in France are female.

In Italy, one out of three cabinet members are women. There are no female leaders and apparently very little interest in Italy to find female leaders.
Women started voting relatively recently in the United States and around the world. For women to actively participate in politics and be world leaders is a new concept for many countries in the Western world.

Victoria LoConte shares details of family's Ronald LoConte Fund

Victoria LoConte

Emergency room staff nurse Victoria LoConte offers a closer look at the charitable fund established to honor her late uncle, Ronald LoConte.

LYNN, MASSACHUSETTS, USA, May 17, 2019 / — Described as gentle, kind, and a peacekeeper, Ronald LoConte relocated from his hometown of Everett, Massachusetts, to Molokai in Hawaii as a young man in order to begin a more selfless, off-grid way of life. Later, he would join the Peace Corps, subsequently spending time in more impoverished nations such as Guatemala, before sadly losing his life to cancer. Here, Victoria LoConte offers a closer look at the charitable fund established in his name and reveals more about her much-loved late uncle.

"After my uncle, Ronald LoConte, very sadly passed away, my family had a square in our hometown of Everett, Massachusetts, adjacent to the city hall, memorialized in his name," reveals Victoria. "We also started the Ronald LoConte Fund," she continues, "subsequently supporting terminally ill children, struggling families, and others in need with all manner of help, gifts, and further assistance."

Described by the family as a gentle and kind peacekeeper, in life, they say, Ronald LoConte selflessly cared for those in need, whether they be friends, family members, or complete strangers.

"After graduating from Brown University, he moved to the island of Molokai in Hawaii to live off-grid, before deciding to join the Peace Corps," reveals Victoria. Here, she says, Ronald became immaterialist and discovered a passion for serving more impoverished nations, later spending time in countries such as Guatemala.

Capable of promptly picking up new languages and regional dialects, locals quickly developed an affinity for her uncle Ronald, says Victoria. "My father, Vincent, often recalls how the children of Guatemala playfully nicknamed his brother 'Gigante Blanco,' or 'White Giant,'" she adds.

While serving in the Peace Corps, Ronald fell ill and was sent to the George Washington University Hospital. "It was at this time that doctors discovered and diagnosed my uncle with colon cancer that had metastasized to his liver," Victoria reveals.

Following surgery to remove a football-sized mass, Ronald was sent home to Everett to continue chemotherapy and radiation, ultimately saddened at seeing children also at the hospital receiving similar forms of cancer treatment to his own. "He said to his sisters, Anna and Maria, at the time, 'You know it's one thing for me as an adult to have cancer. I have lived a full life and have traveled, but these children; they haven't experienced their lives yet,'" explains Victoria.

Tragically, Ronald LoConte lost his fight against cancer on October 25, 1982. He was just 34 years old.

"Our family knew that they needed to keep Ronald's spirit of kindness, generosity, and passion for children alive," says Victoria, "and, in doing so, founded the Ronald LoConte Fund."

She continues, "Knowing the way he felt about children, his brother who was a nurse working at the Whidden Hospital at the time, spoke with the hospice unit's director and asked her to put him in contact with children who were living with terminal illnesses. From there, children were submitting their wishes, and my family was fulfilling them, providing bikes, video games, toys, boom boxes, and more."

A plaque remains with his name, Ronald LoConte, in a square memorialized in his honor at the corner of Broadway and Church Street in Everett, Massachusetts. With the recent passing of his sister, Maria LoConte, in 2018, the family wishes to reboot the fund's efforts by granting scholarships to high school students in the area hoping to major in medicine and other social services.

"It's because of my family residing in and serving the city of Everett, and thanks to the medical care provided from the Whidden Hospital, that I dreamed of becoming a nurse, and working there," reveals Victoria. "In 2017, I'm proud to say, I was able to fulfill this dream, and I continue to think fondly and often of my late uncle and all that he achieved," she adds, wrapping up.

Victoria LoConte is an emergency room staff nurse at CHA Everett Hospital in Everett, Massachusetts. She holds an associate's degree in nursing, obtained from the Lawrence Memorial School of Nursing with Regis College and a bachelor's degree in nursing from Southern New Hampshire University. Prior to her current position, LoConte has also worked as an urgent care facility nurse manager, a case manager, and as a skilled visiting nurse serving the Greater Boston area. Her experience includes adult, geriatric, and pediatric care.

Bestselling Health Author Recommends New Supplement To Reduce Hunger And Make Healthy Weight Loss Easier

No need for dieting or exercise

Learn The Little-Known Secret To Reduce Hunger And Make Weight Loss Nearly Effortless

This is the only biologically correct way for a human to lose weight and become healthier without dieting or exercise and it has never before been taught in America. This will change everything.”

— Gordon Filepas

PRINCETON, NEW JERSEY, UNITED STATES, May 16, 2019 / — Health researcher Gordon Filepas wrote the Amazon Bestseller Lean And Healthy To 100 that was released in 2012. The book teaches people the real root cause of weight gain and other ailments and shows people how to lose weight and heal themselves nearly effortlessly without the need for dieting, hunger, deprivation or exercise.

Filepas believes the approach he uncovered in his book is the only biologically correct way for a human to become lean and healthy to 100 and has NEVER been taught before in America. He believes this is why over 95% of diets fail and America has the fattest, sickest people on Earth despite having the most physicians, health foods, weight loss methods and exercise programs.

If you've already read his book, you know that one of the key points Filepas found in his over 5,000 hours of research over 20 years was that the human body needs far more essential and trace micro-nutrients each day than the 52 the Government recommends. Most Americans are said to only ingest less than 30 micro-nutrients each day. But, health experts he researched recommend that over 100 micro-nutrients are needed by the body each day. Getting all these micro-nutrients is one of the five key points Filepas found that are necessary to balance internal body chemistry to become lean and healthy to 100. Balanced internal chemistry is required for both physical and mental health.

Filepas admits that getting over 100 micro-nutrients a day can be difficult and several products were required to achieve this goal in 2012 when he released his book.

But, there's a new product on the market that was not available when his book was released. This single supplement contains more micro-nutrients that the human body needs each day than any product Filepas has ever found. It's also convenient and affordable for almost anyone. His own family takes this new supplement daily. You can learn about it at

Getting all these micro-nutrients each day fills your 100 Nutrient Buckets(TM) and allows you to eat far fewer calories without being hungry. This relationship between micro-nutrients and reduced hunger, cravings and caloric intake are clearly explained in his book.

See the testimonials on his Amazon book page or at regarding how people lost weight and become healthier and more energetic – even if all diets have failed them in the past.

Filepas believes if every American took this new all-in-one supplement at, losing weight effortlessly would become so much easier. Again, why this happens is clearly explained in his researched-based book.

Filepas also believes if every diet company added this single product containing over 100 micro-nutrients to its program, it would instantly transform their 95% failure rate to a 95% success rate. Micro-nutrients are that essential and powerful for weight loss and health.

People can try this new all-in-one supplement without risk as the manufacturer currently offers a 30 day satisfaction guarantee.

If you have not yet read Lean And Healthy To 100 you can obtain the first 96 pages for free on and no email address is required. Filepas encourages everyone to send this free 96 page PDF file around the world so we can make the people of this world lean and healthy to 100 without dieting, deprivation, hunger or exercise – especially our children.

Community Oncology Alliance Launches Major National Campaign to Stop PBM Abuses and Highlight Patient Horror Stories

PBM Abuses Campaign

PBM Abuses Campaign Launched in Conjunction with Community Oncology Hill Day, Featuring Meetings Between Members of Congress and COA Advocates

Oncologists have long seen how harmful PBMs can be to patient welfare”

— Ted Okon, COA executive director

WASHINGTON, DC, UNITED STATES, May 15, 2019 / — The Community Oncology Alliance is launching a major national campaign to highlight the negative impact of pharmacy benefit managers (PBMs) on patients with cancer. The “PBM Abuses” campaign will ensure that PBM middlemen abuse of patients with cancer is not lost in policy deliberations in Washington.

In recent years, PBM practices and bureaucracies have increasingly been getting in the way of Americans’ access to quality cancer care, oftentimes making decisions based on profits rather than patient need. New policies and proposals put forth by Congress and the Administration would give PBM middlemen more power, instead of less. This will allow dangerous practices, like “fail-first” step therapy and formulary restrictions that cancer care providers know won’t work and may harm patients. Ultimately, oncologists and other cancer care professionals warn that without action, PBM abuses will undermine the incredible, lifesaving progress the United States has made in cancer care and medicine.

While discussions of PBMs and other middlemen often focus only on the economic impact of rules and regulations, there is not enough discussion about the impact they currently have on patients. COA collects reports of real-life patient horror stories in dealing with PBMs and cancer care that capture the suffering experienced at the hands of PBMs due to delayed access to care, denial of coverage, arguments with physicians over proper treatment, and even failure to receive medications.

“Too many of our patients are threatened not just by cancer but also by their PBMs. The PBM Abuses campaign seeks to make sure that their stories and experiences are understood in Washington,” said Michael Diaz, M.D., a practicing oncologist, Florida Society of Clinical Oncology (FLASCO) director of patient advocacy, and COA president. “It is time for Congress to take action to stop PBM abuses. If PBM abuses are not brought under control, the problems they create could undo the progress we have seen in cancer care treatment advances in recent years.”

The PBM Abuses campaign includes an interactive patient stories website at, video education, storytelling online and across the Community Oncology TV network, a strong social and digital media presence, and COA’s national grassroots networks. The goal is to convince lawmakers to take concrete steps to stop PBM abuses that are hurting patients with cancer.

The PBM Abuses campaign is being launched in conjunction with a community oncology Hill Day during which advocates from across the country are attending meetings with Senators, Representatives, and their staff to push for action to stop PBM abuses. The group in Washington today includes physicians, pharmacists, nurses, administrators, patients, caregivers, family members, and survivors from 15 states.

A legislative focus for the advocates will be pushing for support of efforts to rein in PBM abuses, such as the Improving Patient Access to Cancer Treatment Act, or “IMPACT Act.” Under the proposed legislation, PBMs, plan sponsors, insurers, and pharmacies, including specialty and mail order pharmacies, would have to ensure that a patient with cancer is able to receive their prescription medication within 72 hours of submission. This includes any time needed for prior authorization or reviews by the pharmacy benefit plan provider. If this is not possible, then the patient would be able to obtain the prescription medication from any other licensed pharmacy, and have the service covered under the patient’s plan and benefits.

“Oncologists have long seen how harmful PBMs can be to patient welfare,” said Ted Okon, COA executive director. “No longer will they tolerate a third party PBM inserting itself between the patient and the physician, limiting access to care, delaying the start of care, failing to properly manage patients, and increasing the cost of care every step of the way. This must stop now!”

Additional information about the PBM Abuses campaign is available at

New Immigration Podcast Brings Thoughtful Insight to Polarized Issue

Mark Jason, Founder & CEO, Immigrant Tax Inquiry Group

First six episodes of “Perspectives on Immigration Reform” podcast are live on Apple Podcast and PodBean

Immigration has people fired up all around the country, but nobody was offering thought leadership that could actually bridge the emotional divide and bring people together toward consensus.”

— Mark Jason

MALIBU, CALIFORNIA, USA, May 15, 2019 / — A new biweekly podcast called “Perspectives on Immigration Reform” is bringing a balanced and intelligent perspective to one of the most hotly debated topics in society. The podcast’s first six episodes are available via Apple Podcast and PodBean. You can listen to the podcast episodes HERE.

“Immigration has people fired up all around the country, but nobody was offering thought leadership that could actually bridge the emotional divide and bring people together toward consensus,” said Mark Jason, founder of the Malibu, California-based Immigrant Tax Inquiry Group (ITIG).

ITIG believes polarization has defined — and distorted — the nation’s thinking about immigration reform for far too long. The “Perspectives on Immigration Reform” podcast provides fresh insights, ideas and information while offering a balanced vision to help mitigate many of the concerns Americans have with our nation’s broken immigration system.

Hosted by ITIG spokesperson Sean O’Neill, the podcast features guests representing a full range of viewpoints, who provide a deeper understanding of both the policy side and the human side of immigration. Guests include political figures, nonprofits and advocacy groups, as well as engaging authors and thought leaders.

The podcast springs from the same spirit of balance and helpfulness that led to ITIG’s founding and the development of its vision for addressing immigration reform. Over the past eight years, ITIG has refined its immigration reform model to incorporate input from elected officials, their staff members, other think tanks and non-governmental organizations involved in various aspects of immigration.

ITIG’s model enhances most other proposals by dealing with the realities of funding the effects of our broken immigration system. It affords accountability and fairness to U.S. taxpayers, immigrants and employers. For details on the model, visit

About Immigrant Tax Inquiry Group
Immigration Tax Inquiry Group (ITIG) is a not-for-profit, non-partisan and privately-funded organization that is dedicated to breaking the persistent gridlock that has left America’s immigration policy in a state of philosophical and political paralysis. The group was created on the core principle that immigrants and those who employ them should be part of the solution. Mark Jason, Founder & CEO of the Immigrant Tax Inquiry Group, is a former Special Agent for the Internal Revenue Service. He served as a budget analyst for the California State University System, and as a consultant for the Mexican government.

Trends in Healthcare in 2019 with Himachal Mukhopadhyay

Himachal Mukhopadhyay

2018 was a huge year for healthcare. The trends continue in 2019. Himachal Mukhopadhyay discusses.

ROSEVILLE, CALIFORNIA, USA, May 15, 2019 / — Healthcare is without a doubt one of the most important industries in the country. For the United States, the healthcare industry has been at the center of economical and social discussions for the better part of a decade, and it all came to a head in 2018 with a series of announcements of massive changes which shook the healthcare industry from the core upwards. This trend has continued into 2019, and we’re now seeing the effects of these trends coming into effect. Below, with the help of Himachal Mukhopadhyay, we’re going to discuss what these trends are and what both patients and payers can expect as the year progresses.

Digital adoption and robotic process automation

According to Himachal Mukhopadhyay, robotic process automation and digital adaptation are changing the landscape of healthcare across the board. The reason for this has to do with the fact that robotic process automation allows professionals to automate low-level tasks so that they can reserve their concentration for higher-level, more complex tasks. These tasks include inputting data and other monotonous, routine jobs. It is hoped that this will allow doctors and other medical professionals to free up their time for more pressing, engaging and intellectually heavier work.

Electronic medical records

According to Himachal Mukhopadhyay, electronic medical records of EMRs, have been quite widespread and available for sometime now, so the acquisition and introduction of them is nothing new. However, throughout 2019 we’re going to start seeing some of the benefits of having EMRs around. This means that doctors will instantly have access to a patient’s medical history at the touch of the finger, enabling them to provide better, more-informed healthcare than they would have been previously been able to.

Artificial intelligence

AI is the buzzword on everyone’s lips, and that includes the healthcare industry. According to Himachal Mukhopadhyay, recent progressions in artificial intelligence are set to have a massive impact on the healthcare industry. For example, in countries where doctors aren’t readily available, artificial intelligence will be able to be used in order to accurately diagnose patients in the absence of trained professionals.

Enhanced focus on security and compliance

As with many other processes in 2019, there has been an increased focus on enhancing security and compliance throughout the healthcare industry. As data becomes an evermore valuable commodity, pains must be taken to keep this data safe. This is especially true for doctors who wish to communicate swiftly and securely while still adhering to compliance. Because compromised systems can also cause a complete failure of a healthcare electronic records system, it’s imperative that security and compliance to regulations are the strongest they can possibly be.

Longshore Act in Action – Real-World Cases

This blog covers some real-world cases so you can better understand how the Longshore and Harbor Workers’
Compensation Act works in real time.

JACKSONVILLE, FLORIDA, USA, May 15, 2019 / — You have probably, at some point in your life, looked at the instructions on a piece of furniture that you buy at Target or IKEA and think, “Sure, that looks as easy as 1-2-3, there’s just a few steps here.” Has it then played out that when you actually try to put that piece of furniture together it is like you are living a nightmare from which you can never escape?

You have also probably looked at a recipe before the big dinner, maybe when you are shopping for the ingredients, and said to yourself, “No problem, this recipe looks easy, I got this.” Then, has it happened that you can’t seem to get it all together when you are actually trying to cook the meal, or your dinner looks like a slightly brown, squished version of the picture in the cookbook?

Strangely enough, those real-life examples tell us something about the law as well. Many times, you can read a statute, rule, or regulation and think that it seems to make sense and it seems pretty clear. Yet, when you actually try to apply that statute, rule, or regulation to a certain situation, all of the sudden you find that a word is ambiguous or does not quite fit with the specific facts with which you are dealing.

It is for that reason that you should periodically have a check in, where you see a law in action to understand how it really works. With regard to the Longshore and Harbor Workers’ Compensation Act (Longshore Act), we can blog about different provisions, discuss situs and status, and even define the difference between scheduled and unscheduled injuries. However, applying those rules and definitions to examples demonstrates how the Longshore Act works in action, in the real world.

Accordingly, we are going to provide you with some recent Longshore Act cases that will help give a little perspective and context to the abstract rules that we often discuss in our Longshore Act and Defense Base Act blogs.

Recent Case #1: The Widow and the Third-Party Settlements

In the case of Beverly Hale v. BAE, a ship repair worker died as a result of exposure to asbestos in his employment. Two of his daughters filed lawsuits in court against the asbestos manufacturers. In addition, the worker’s widow filed Longshore Act claim for survivor’s benefits.

Under the Longshore Act (Section 33 to be exact), an injured worker or the family of a deceased worker may sue for the work-related injuries in court, but an employer may off-set any money it would have paid to an injured or deceased worker if that worker (or his family) received money from those lawsuits. In other words, if someone is getting money from a lawsuit, then the employer can factor in that income when determining how much to pay in workers’ compensation benefits.

The issue in the case became: Will the widow’s survivor benefits be reduced because the widow may receive money from the two lawsuits brought by the daughters?

The widow tried to avoid losing survivor benefits through the Longshore Act by signing two disclaimers, renouncing her interest in the two lawsuits. However, the daughters ultimately settled the lawsuits on behalf of the deceased worker’s “heirs.” The widow was one of the worker’s “heirs.”

The Department of Labor’s Administrative Law Judge decided that the widow’s disclaimers were not enough, and that the employer could reduce her Longshore Act benefits based on the fact that she was an “heir” who would receive money from the settlement of the two lawsuits. On appeal, the Benefits Review Board agreed.

The moral of this case. Section 33 of the Longshore Act allows the family of a deceased worker to sue third parties in court based on an employment-related death. However, that same section also provides that the amount of benefits a family member can receive under the Longshore Act will be reduced based on the money received from the lawsuit.

Recent Case #2: The Word “Employee” and the Clerical Exclusion

As you may know, the Longshore Act provides workers’ compensation for certain types of employees. Specifically, under the Act an “employee” is any person engaged in maritime employment, including a longshoreman or person engaging in longshoring operations. It also covers any harbor worker such as a shipbuilder, ship repairman, or ship breaker.

Importantly, Section 2(3)(A) of the Longshore Act (the so-called “clerical exception”) states that the term “employee” does not include: “Individuals employed exclusively to perform office clerical, secretarial, security, or data processing work.”

In the case of Motton v. Huntington Ingalls Indus., a person with the title of Drawing Clerk made a claim under the Longshore Act. Her duties were to retrieve documents from trade workers (such as blueprints), verify that they were current, and then check them in and out, similar to a library. Her duties did not involve boarding ships.

The Administrative Law Judge denied Longshore Act benefits, finding that she fell under the clerical exception. Ms. Motton, however, claimed that she should be covered because her duties, though clerical, were essential to the loading and unloading of vessels. The Benefits Review Board affirmed the denial of benefits because the specific clerical exception superseded the fact that her functions were essential to operations.

The Drawing Clerk was covered, however, by the state’s workers’ compensation law instead.

The moral of this case. Be aware that there are exceptions to coverage under the Longshore Act, the clerical exception being one. So, if you work at a dock, consider whether your duties may be considered “clerical” and therefore outside the Longshore Act.
