LOS ANGELES, CA, UNITED STATES, June 2, 2020 /EINPresswire.com/ — As the California economy opens up again and companies begin to invite employees to the workplace, common questions arise from employers on what they are permitted to do with respect to their returning employees. In addition, many questions remain on how the Paycheck Protection Program (“PPP”) loan may be used to qualify for forgiveness. Below, we provide five of the most common questions recently asked in hopes that it gives you some helpful tips – used for informational purposes only. Should you have any follow-up questions on the topics or on any related matters, do not hesitate to call or email us.

1. If your employee took paid or unpaid COVID-related leave, can he/she return to the old job upon return to the office?

Yes. In most circumstances, an employee returning from a Families First Coronavirus Response Act (“FFCRA”) paid sick leave or family leave must be restored to the same or equivalent position prior to the office closure. However, the employer may deny accepting the employee back to his/her former position if (i) the employee would not have otherwise been employed if, due economic reasons, the employer would have terminated that position (e.g. due to a company layoff), or (ii) if denying restoration is necessary to prevent "substantial and grievous economic injury" to the employer's operations.

Under the FFCRA, an employee working for an employer with fewer than 25 employees may be denied restoration to his/her former position if:

· (i) the employee took leave under the Emergency FMLA for child-care reasons;

· (ii) the employee's position no longer exists because of economic conditions or other changes caused by the public health emergency during the leave period; and

· (iii) the employer makes reasonable efforts to contact the employee if an equivalent position becomes available during the one-year period after the employee's leave.

2. Is an employee eligible for unemployment if he/she had to quit due to reasons related to COVID-19?

Yes. An employee is generally not eligible for unemployment if he/she quit without good cause. However, if he/she quits for reasons related to COVID-19 (for example, having to stay home to take care of a sick family member, for kids that are out of school, or for children when no childcare can be obtained), he/she may be eligible for unemployment benefits under the CARES Act. Please note that quitting without good cause simply to obtain unemployment benefits is considered fraudulent and may result in having to pay back the benefits and prosecution.

3. For the Paycheck Protection Program (“PPP”) to be forgiven, how must the company use the funds?

For eight weeks from the date of funding, at least 75% of the funds must be used towards “Payroll Costs,” and the other 25% must be used toward Rent and Utilities. Contact us for a spreadsheet or any related guidance. “Payroll Costs” include:

-Salary, wages, commissions, or tips (capped at $100,000 on an annualized basis for each employee);

-Employee benefits including costs for vacation, parental, family, medical, or sick leave; allowance for separation or dismissal; payments required for the provisions of group health care benefits including insurance premiums; and payment of any retirement benefit; and

-State and local taxes assessed on compensation.

4. What if the employer cannot use the PPP funds during the eight-week period?

If you cannot use the PPP funds during the eight-week period, it can be returned or paid back over two years at a 1% interest rate (with a six-month payment deferral to start). If an employee does not return to work, the employer may still pay her from the PPP at least 75% of her usual pay even if she is not working. The alternative is to return the loan if you believe that the wages are not required to support the ongoing operations of the business.

5. What should an employer do if the employee refuses to return to work?

If the employee refuses to return to work (or quits), the employer may hire a replacement employee or temp to maintain the employee headcount. Even if the employee claims she was laid-off to collect unemployment benefits, and the employer asked her to return to work and the employee refuses, the employer will not be penalized under the PPP if the employer achieves the same employee headcount by June 30, 2020. Remember that the employer only has to return to the same employee number that it had as of February 15, 2020 to qualify for loan forgiveness. Finally, the employer can aim to restore/maintain the wages to within 25% of the previous pay level and still obtain loan forgiveness under the CARES Act. Make sure to document that the employee refused to return to work after you contacted her (in writing) and offered her the same pay.

The Transnational Government of Tamil (TGTE) joins the international community in condemning China’s plan to unilaterally enact a so-called “security” law on Hong Kong. TGTE is deeply concerned that the plan, approved by the Chinese legislature on May 28, infringes on the fundamental rights of the people of Hong Kong to freedom of speech, freedom of association, and to the free flow of information.

While China claims the law is needed to prevent and punish “subversion, secession, and terrorism” against China in Hong Kong, Eelam Tamils (i.e. Tamils from the island of Sri Lanka) know all too well from their own history in Sri Lanka that so-called security laws like these are nothing more than tools for oppression.

Eelam Tamils also share the concern expressed by Australia, Britain, Canada, and the United States in their joint statement that China’s proposed security law will dramatically erode Hong Kong's autonomy, which is guaranteed by the Sino-British Declaration that China agreed to when the United Kingdom handed Hong Kong over to China in 1997. Beijing's plan to bypass seeking approval of the yet-to-be-drafted national security law for Hong Kong from the Hong Kong legislature and instead, unilaterally impose a rights-curtailing law on the people of Hong Kong is a violation of current system of governance in Hong Kong, known colloquially as “one country, two systems,” which protects Hong Kong’s autonomy.

Democratic protesters in Hong Kong, especially students, gained the world’s attention during the second iteration of the 2014 "Umbrella Movement" in 2019, which successfully killed China’s proposed extradition bill that would have dissolved the vital separation between the Hong Kong judicial system and mainland China’s judicial system. TGTE held the hands of protestors in Hong Kong then and continues to hold the hands of protestors in Hong Kong now in the spirit of solidarity and camaraderie in our respective fights for freedom.

TGTE also take this opportunity to condemn China's military square off with Indian troops along the border in the Himalayas. There is no room for military adventurism, especially while the world is suffering from Covid-19. The need of the hour is cooperation and humanitarian action.

Finally, after seven months, the mullahs' Interior Minister admitted the murder of 200 people during the November uprising, claiming that 40 or 45 people or about 20 percent of them had been killed by non-standard weapons

Seven months after the November uprising, while trying to minimize the number of victims of November 2019 uprising by 10 percent of the actual figure, Abdolreza Rahmani-Fazli, Rouhani's Interior Minister admitted last night that more than 200 protesters had been murdered. Yet, terrified of a backlash, he preposterously claimed that 20 percent of the victims had been killed by non-standard weapons, insinuating that the regime's opponents murdered them. Nevertheless, Rahmani unwittingly conceded that the regime murdered more than 80 percent of the victims.

In an interview with the state-run TV on May 30, 2020, Rahmani-Fazli said: "They (enemy) announced that 10,000 people were killed, 8,000 were killed, 7,000, 6,000. They even mentioned 2,000. God willing, we will announce the figures in the next few days. The fatalities are not in these ranges at all. I want to say that 20 percent of the toll, somewhere between 40 to 45 of the victims have been registered as martyrs. They were innocent and happened to be in streets and were killed by such weapons and such tactics that none of which are deployed by the State Security Force or other government agencies."

Acknowledging the Internet outage, the regime's Interior Minister underscored the massive dimensions of the November protests, "They say that Rahmani cut off the Internet during those nights. Of course, I did because they provided training and commanded the field via the Internet… The reason they are upset is that they wanted to initiate a civil war. For several months then, we, as the country's security officials, had been surveilling them … The price of gasoline provided an opportunity for this to flare up … If there was a broad dimension and social context, it would have been much bigger than this… They wanted to disrupt the country and cause insecurity, turn this to another Syria… Maintaining security is important for all of us, and is the basis of all activities."

As reported by Etemad daily on December 17, 2019, Rahmani Fazli is the same criminal who, when confronted last December by a regime parliament deputy that "Two people in my constituency were shot in their heads. Was it not possible to shoot at them, at least in their lower parts of the body, he brazenly replied, "Well, shots were also fired at their feet!"

The People's Mojahedin Organization of Iran (PMOI / MEK) announced for the first time on December 15, 2019, that the number of martyrs in the November Uprising exceeded 1,500 and published the names of 765 of those martyrs. Eight days later, on December 28, Reuters quoted three Iranian Interior Ministry officials as saying, "About 1,500 people were killed during less than two weeks of unrest that started on November 15." Reuters pointed out, "The figures provided to Reuters, said two of the Iranian officials who provided them, are based on information gathered from security forces, morgues, hospitals, and coroner's offices."

Rahmani-Fazli's remarks last night that the number of the martyrs of the November uprising would be announced in the coming days are the continuation of a scandalous process of the regime's officials blaming each other which reflects their fear of the consequences of the mass murder and crimes against humanity during the November uprising.

On February 15, Hassan Rouhani, in response to a question about the number of people killed in the November riots, said that the figures were available to the country's Coroner's office, which could be announced. Subsequently, the head of the country's Coroner's office organization announced that according to the decision of the National Security Council, the government has to publish these figures. Five days later, Ali Rabeie, Rouhani's government spokesman, said on the sidelines of the cabinet meeting, "What the president said was based on the fact that coroner's office is the authority to announce the cause of death and the issuance of the burial permit …" He added: "Coroner's office has announced (the number of those killed) in a letter. Of course, we would have to wait for the official announcement of Coroner's office, which did happen, but it was not enough. Field surveys and reports from operating agencies on the causes of death and how to proceed were also taken from the police and security agencies. Rabeie added: "Accurate figures along with how to proceed will be announced soon by the relevant authorities."

The Iranian Resistance has consistently emphasized that by any measure, the November massacre was a crime against humanity and that the regime's leaders and officials must be prosecuted and held accountable by an international tribunal.
